Know Your Rights – Actively Develop AI Works Agreements

Artificial intelligence (AI) is changing the world of work – including in the works council office. Whether in personnel planning, performance evaluation, or recruitment: The use of AI raises many questions. What does artificial intelligence mean in concrete terms for the company? What are the consequences for employees? And how can the works council monitor and evaluate AI processes and exercise its co-determination rights regarding AI?

This practical AI training for works council members is aimed at those without prior AI knowledge and conveys the most important basics about AI in the workplace – including legal frameworks and co-determination rights when introducing AI in the company. The goal is to become proactive early on and to build AI expertise as a works council member. A special focus is placed on drafting works agreements and on the new mandatory training on AI topics, which has been in effect since February 2025.

Objective: You will learn how to use AI in the works council, critically examine processes, and responsibly support AI implementation together with the employer.

Understanding Your Rights, Ensuring Data Protection, Regulating AI

Microsoft 365 is standard practice in many companies – but what about data protection? Which functions are used, and where does data flow? Works councils face numerous questions regarding data protection, co-determination, and the use of digital tools such as Copilot, Workplace Analytics, and cloud services.

This seminar provides a concise and practical overview of how works councils can evaluate and actively participate in the use of Microsoft 365. You will gain insights into functions, risks, and licensing models, analyze data protection aspects, and learn how to structure your internal works council’s responsibilities for using MS Office: from framework agreements to module-specific works agreements. The seminar also clearly explains how to use AI applications like Copilot – including their legal classification.

Objective: You will learn how to regulate and use Microsoft 365 and AI tools like Copilot in compliance with data protection regulations and how to actively exercise your participation rights.

Co-determination, Data Protection & Design Options

■ Co-determination rights when using Microsoft 365 are explained based on the relevant sections of the German Works Constitution Act (BetrVG) (§§ 80, 87, 90, 95 ff., 111 ff.)
■ Data protection classification according to the GDPR and the special considerations for cloud solutions
■ The use of Microsoft 365 Copilot: potential risks and co-determination issues with AI tools are presented using application scenarios
■ AI and Copilot are classified with regard to the EU AI Act
■ The method of technology impact assessment is presented and applied practically using the example of Microsoft 365
■ Design options for works agreements through process-based agreements, framework agreements, and module-based agreements are demonstrated
■ In the practical application, you will identify areas for action and develop initial ideas for regulations
