Our aim is to make economic relationships understandable, to present alternatives, and to represent the interests of employees on equal footing with management. We combine in-depth business knowledge with many years of experience advising works councils and trade unions – independently, transparently, and with a results-oriented approach.
Reconciliation of interests / Social plan
In negotiations concerning agreements on the reconciliation of interests and social plans pursuant to Sections 111 and 112 of the German Works Constitution Act (BetrVG), we support works councils and trade unions with independent business and strategic consulting. We assist in analyzing the initial economic situation, reviewing employer proposals, and evaluating planned operational changes as defined in Section 111 of the BetrVG. A particular focus is on analyzing personnel planning pursuant to Section 92 of the BetrVG, including personnel requirements, qualification, and capacity planning, as well as evaluating alternatives to staff reductions and site closures.
Based on this analysis, we develop robust counter-proposals, assess the economic and personnel impacts, and identify negotiating and action options. In social plan negotiations pursuant to Section 112 of the BetrVG, we analyze the company’s economic performance, quantify the financial disadvantages for employees, and support the development of socially balanced and legally sound compensation arrangements.
Our advice is provided as expert support in accordance with Section 80 Paragraph 3 of the Works Constitution Act and expressly includes the preparation and support of conciliation board proceedings, including the preparation of economic decision-making bases, the development of negotiation strategies and professional support during the conciliation board proceedings.
Coordination and Operational Project Management
In restructuring and transformation processes, we support works councils and trade unions with structured, operational project management. We handle the planning, steering, and coordination of complex projects, define clear project structures, roles, and responsibilities, and develop realistic timelines and action plans. In doing so, we ensure the systematic recording, processing, and prioritization of economic, personnel, and organizational issues.
Our services include the preparation and moderation of project and steering committee meetings, the coordination of external consultants and experts, as well as ongoing progress and risk monitoring. We support the documentation of work results, the derivation of concrete steps for action, and the integration of project work with negotiation processes regarding the reconciliation of interests, social plans, and conciliation committees. The goal is to manage projects efficiently, ensure transparency, and guarantee the assertiveness of employee representations even under high time and decision-making pressure.
